According to a Reuters report, the Supreme Court yesterday refused to entertain a plea by Kingfisher Airlines to stay a probe by the anti-monopoly watchdog, the Competition Commission of India (CCI), into the strategic tie-up of the airline’s with Jet Airways. The CCI is investigating to find out if the alliance amounted to an anti-competitive agreement including cartelisation, as well as abuse of market dominance. The apex court declining to pass a stay order in the matter in effect means Kingfisher Airlines will have to cooperate in the probe.
Earlier, the Bombay High Court had given an order favouring CCI in the matter. Acting on a Special Leave Petition filed by Kingfisher Airlines, a bench headed by Chief Justice of India, S.H. Kapadia, noted the statement of the Additional Solicitor General, Parag Tripathi, who along with the law firm Economic Laws Practice is representing CCI - that the airlines was not co-operating in the investigation by CCI.
